Starting April 21, 2026, the New York City Department of Environmental Protection requires continuous noise monitoring on qualifying large construction projects—making compliance mandatory, documented, and enforceable.

The DEP has made it clear, the responsibility is on the developer to monitor noise levels. If you are a:

  • General Contractor
  • Construction Manager
  • Developer
  • Environmental Consultant

…working on large NYC projects, this regulation applies to you.

Your new project must comply if ALL of the following apply:

  • Requires an Alternative Noise Mitigation Plan (ANMP)
  • Construction lasts 30 days or more (consecutive or not)
  • Building size is ≥ 200,000 sq. ft.
  • Work occurs within 50 feet of a residential receptor

If these conditions are met, you must install at least one noise monitoring device on-site.

The DEP has made it clear, the responsibility is on the developer to monitor noise levels. If you are a:

  1. Continuous, 24/7 Monitoring
    • Monitoring must run throughout construction
    • Can only stop when work is limited to interior or minimal-noise activities
  2. Device Placement & Setup
    • Installed 8–10 feet above ground
    • Positioned facing the nearest residential or sensitive receptor
    • Wall-mounted devices must be ≥1 ft. from nearest surface to avoid reflection
    • System must include
      • Outdoor-rated microphone with wind and rain protection
      • Weather-protected enclosure
      • Minimum of IEC 61672-1 Class 2 compliance
  3. Data Collection & Reporting
    • Measure sound in A-weighted decibels (dBA)
    • Capture Lmax levels in 5-minute intervals
    • Transmit time-stamped data at least hourly to DEP

Your submission must now include:

  • Map of receptors within 75 feet
  • Monitor locations
  • Number of devices
  • Responsible party info
